Terms of Service

1. Eligibility & Sanctions Compliance

You must be at least 13 years of age to use MatchPly. Users between the ages of 13 and 18 ("Minors") may only use the Service under the direct supervision of a parent, legal guardian, or authorized sports instructor/coach. Minors under 13 are strictly prohibited from creating accounts.

By using the Service, you represent and warrant that:

• You have the legal authority to enter into these Terms.
• You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country.
• You are not listed on any U.S. Government list of prohibited or restricted parties.

2. Account Registration and Security

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and keep your credentials secure. You are solely responsible for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

3. User Conduct and Prohibited Activities

MatchPly is built on community and fair play. You agree not to engage in prohibited activities, including but not limited to:

• Harassing, bullying, threatening, or inciting violence against other users online or during physical matches.
• Creating fake accounts, impersonating others, or manipulating match statistics.
• Uploading malware, scraping data, or disrupting technical infrastructure.
• Promoting illegal acts, excessive drinking, drug use, or self-harm.
• Creating, uploading, or distributing child sexual abuse material (CSAM) or exploiting minors.

Reporting and Blocking: MatchPly provides in-app tools to report abusive content or behavior and to block other users. We encourage users to use these tools whenever they encounter conduct that violates these Terms. Reported content and accounts will be reviewed in accordance with Section 4 (User-Generated Content & Apple Moderation Standards).

4. User-Generated Content (UGC) & Apple Moderation Standards

Users may upload profile photos, team logos, handles, and custom event descriptions ("User Content").

• License Grant: You retain ownership of your content, but grant MatchPly a non-exclusive, worldwide, royalty-free license to store, display, and process your content solely for operating the Service.
• Zero Tolerance for Objectionable Content: Objectionable content—including hate speech, harassment, pornography, or intellectual property infringement—is strictly prohibited.
• 24-Hour Takedown Policy: In compliance with App Store guidelines, reported objectionable content will be reviewed and removed within 24 hours, and the offending user account will be barred/terminated.
• Trademark Protection: Users must not use any third-party trademarks, logos, brand names, or intellectual property without proper authorization, including but not limited to those belonging to professional sports clubs, federations, brands, or other organizations. If you believe your copyright or trademark is infringed, contact [email protected] for removal within 48 hours.

5. Fees, Subscriptions, and App Store Purchases

MatchPly may offer premium subscriptions or event registration fees.

• App Store Processing: Purchases processed via Apple App Store or Google Play Store are subject to those platforms' respective payment terms.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period via your device's App Store settings.
• Refunds: All purchases are generally non-refundable except where required by applicable law or platform policies.

6. Third-Party Organizers & Field Venues Disclaimer

MatchPly acts solely as a technology platform connecting players, venue hosts, and event organizers. MatchPly does not own, operate, or supervise physical sports venues or independent tournaments. We are not responsible for the quality, safety, cancellation, or fulfillment of third-party events.

7. Physical Sports Safety & Assumption of Risk

PARTICIPATION IN RECREATIONAL SPORTS INVOLVES INHERENT RISKS OF BODILY INJURY, ILLNESS, OR PROPERTY DAMAGE. YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH ATTENDING OR PARTICIPATING IN MATCHES ARRANGED THROUGH THE SERVICE. MATCHPLY IS NOT LIABLE FOR ANY INJURY, INCIDENT, OR DISPUTE OCCURRING AT PHYSICAL VENUES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATCHPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, INTERACTIONS WITH OTHER USERS, OR PARTICIPATION IN MATCHES.

9. Indemnification

You agree to defend, indemnify, and hold harmless MatchPly, its officers, directors, and employees from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising from your breach of these Terms, your User Content, or your participation in physical sports activities.

10. Account Termination

We reserve the right to suspend or permanently delete your account at any time without prior notice if you violate these Terms or pose a safety risk to the community.

12. Apple Specific Provision

If you download the app via the Apple App Store, you acknowledge that these Terms are concluded between you and MatchPly only, not Apple. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
